Quite simply the proposed development site is not an allocated site in the local plan and the location of this proposal is outside the Modbury settlement boundary. The Neighbourhood Plan itself was adopted on 30th March 2023, just two years ago after an examination by the Independent Examiner and approved by referendum. It therefore takes precedence over any existing non-strategic policies in the JLP where they might be in conflict’
Not only is the northernmost part of the site classified as best and most versatile agricultural land upon which any development should be avoided, but the LPA is required to protect the special characteristics and role of the countryside.
Modbury has also experienced no little development in recent years and has grown by almost a quarter in the ten years between 2011 and 2021. By 2023 South West Water were admitting the local 70-year-old sewage works was approaching design capacity. Since then a further 40 dwellings have been built and also year the works spilt sewage on no fewer than 124 separate occasions for a total of 1,269 hours. Adding a further 75 dwellings is only likely to add to the existing pollution problems.
Separately the Parish Council have made the point that 'It has taken several years of intensive effort on the part of a former Parish Councillor and SHDC Planners to ensure that the promises made by the developers for the original Bloor site have been delivered. The Parish Council is aware of at least one issue which has not yet been resolved'. This application has also been submitted by Bloor Homes.
Finally no additional employment land has been identified so the residents of any development will almost inevitably have to commute to work elsewhere in the county.
