A Section 73 planning application was recently submitted by Blakesley Estates to vary Condition 7 of their existing outline Lock’s Hill planning permission. “The intention,” said Blakesley, “is that, subject to the LPA’s approval, the Section 73 application would create a new planning permission, including a new Condition 7, which approves Blakesley Estates’ revised plans for access, appearance, layout and scale.”
The LPA, South Hams District Council, have since validated the application, despite recognising that it is for a revised layout.
The Society believes they should not have done so as, in our opinion, Blakesley have misused Section 73 to extend the time allowed for the submission of a reserved matter, namely that of a revised layout.
